The clogged up legal system: 23 August 2007
Our frustrations about the amount of time it can sometimes take to get a tenancy issue into The tenancy Tribunal have been partly answered by new research.
The tenancy tribunal is a great resource for us but we have been frustrated by the sometimes long delays of up to a month to get a date there, which only adds to the landlords costs. The latest reseach however has revealed why this is, and its quite interesting. A survey of 818 first time landlords showed why the tribunal is clogged up with cases caused by first time and ill informed landlords who didn't get it right and now ask the courts to fix it, often loosing their cases. There is a good supply of case history to illuminate that point which we will publish soon. The survey showed that 36% of landlords never carried out inspections, 25% collected 3 weeks bond and 67% collected only 2 weeks bond and only 22.9% used a licensed property manager. The Department of Building and Housing now runs workshops for first time landlords and gets a good reponse, they always hand out a leflet to them suggesting the benfits of using an REINZ property manager. They do this because they know that we are less likely to create a situation leading to Tribunal action beacuse we know what we can and can't do and we are tougher than new landlords on tenant selection.
I have been appointed to the National Customer Service Council for the Department of Building and Housing as a delegate for Waikato/BOP. That allows me top floor access into the dept to iron out problems and talk face to face with the right people, so I listen to issues raised by REINZ members in this area and get them heard and responded to quickly and accurately. I have to say that the dept. has been working hard on getting the new system correct and problems are now largely a bad memory.
So if your tribunal case is slow getting a hearing then now you know why!! Richard Evans
